Terms of Use
These Terms govern your use of Goutly. They are a real agreement between you and the developer of Goutly, so please read them. By downloading, installing, or using the app, you accept these Terms.
1.Acceptance
By downloading, installing, or using Goutly, you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the app. If you are using Goutly on behalf of someone else, you confirm you are authorized to accept these Terms for them.
2.Eligibility
You must be at least 13 years old — or the minimum age of digital consent where you live, whichever is higher — to use Goutly. The app is designed for adults managing their own gout treatment and is not directed at younger children.
3.License
We grant you a limited, non-exclusive, non-transferable, revocable license to download and use one copy of Goutly for your personal, non-commercial use on an Apple-branded device that you own or control, running a supported version of iOS, in accordance with the Usage Rules in the Apple Media Services Terms and Conditions.
You may not: sublicense, rent, lease, lend, sell, or redistribute the app; copy it except as permitted by these Terms; or remove any proprietary notices. This license does not transfer any ownership rights to you.
4.Price
Goutly is currently free to download and use. There is no subscription and no in-app purchase. If we ever introduce paid features, the price and any purchase terms will be shown clearly before you buy, and any purchase would be processed and billed by Apple through your Apple ID. Apple handles all billing and any refunds under its own terms.
5.Acceptable use
You agree not to:
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the limited extent this restriction is prohibited by applicable law;
- Interfere with, disrupt, or attempt to bypass any security or technical limitation of the app;
- Use the app for any unlawful purpose or in violation of these Terms;
- Use the app on a device you do not own or are not authorized to control.
6.Intellectual property
Goutly, including its software, name, logo, design, and content we provide, is owned by Hung Le Ngoc (trading as XBoost) and is protected by intellectual-property laws. These Terms grant you a license to use the app; they do not grant you any ownership of the app or its branding.
7.Your content & data
The information you enter — your medications, doses, uric acid readings, and flare logs — is yours. Goutly stores it locally on your device and does not upload it to us or anyone else, as described in our Privacy Policy. We claim no ownership over your entries and never access them. Because your data lives on your device, keeping your own backups and keeping your device secure are your responsibility.
8.Health disclaimer
Goutly is a wellness and tracking tool, not a medical device. It does not diagnose, treat, cure, or prevent any disease, and it does not provide medical advice or dosing recommendations.
Goutly helps you record and keep to the treatment your doctor has already prescribed — it is not a substitute for professional medical care. Always follow your doctor's instructions and consult a qualified healthcare professional before making any change to your medication or treatment. Never disregard professional medical advice, or delay seeking it, because of something in the app. If you think you may have a medical emergency, contact your doctor or emergency services immediately. You are responsible for the accuracy of the information you enter and for any decisions you make.
9.Disclaimers & liability
Goutly is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that reminders will always be delivered by your device.
To the fullest extent permitted by law, the developer will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the app. Because Goutly is provided free of charge, our total liability to you for any claim relating to the app will not exceed the greater of the amount you paid for the app (if any) or fifty US dollars (US$50). Some jurisdictions do not allow certain limitations, so some of these may not apply to you; nothing in these Terms limits any liability that cannot be limited under applicable law.
10.Apple-specific terms (EULA)
These Terms are between you and the developer of Goutly only, and not with Apple. The following terms apply because you downloaded the app from the Apple App Store:
- Acknowledgement. This agreement is concluded between you and the developer, not Apple. The developer, not Apple, is solely responsible for Goutly and its content.
- Scope of license. The license granted to you is limited to a non-transferable license to use Goutly on any Apple-branded device you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Maintenance and support. The developer is solely responsible for providing any maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- Warranty. The developer is solely responsible for any product warranties, whether express or implied. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Product claims. The developer, not Apple, is responsible for addressing any claims relating to the app, including product-liability, legal or regulatory compliance, and consumer-protection claims.
- Intellectual property. In the event of any third-party claim that the app infringes intellectual-property rights, the developer, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
- Legal compliance. You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting,” and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
11.Termination
You may stop using Goutly and delete it from your device at any time. We may suspend or terminate your license if you materially breach these Terms or use the app unlawfully. Provisions that by their nature should survive termination — including intellectual property, disclaimers, and limitations of liability — will continue to apply.
12.Governing law
These Terms and the relationship between you and the developer of Goutly are governed by the laws applicable to your place of residence, without regard to conflict-of-laws principles.
13.Changes
We may update these Terms from time to time. When we do, we will change the “Last updated” date above, and for material changes we will make the update clear — for example, through an in-app notice or on this page — before it takes effect. Continuing to use the app after an update means you accept the revised Terms.
